The trial and execution of officer Abu-Mustafee_________________

The officer Abu-Mustafee was executed by firing squad Friday, February 25th morning at 2:00 am after being found guilty of molesting a 6-year old child, Abu-Shamaleh, from the Khan Yunis refugee camp. The death penalty had been imposed by a military court on Thursday 25 February, 1999 at 11:30pm.

Following the widespread Palestinian public anger that came in response to the crime committed by Abu-Mustafee, Addameer Institution for the Care and Protection of Prisoners and Human Rights believes it is essential to stress the following:

  1. We believe that the death penalty is not a deterrent. The PA is called upon to investigate the measures and procedures necessary to prevent the repetition of such crimes.

  2. We support the complete implementation of the rule of law but this will not take place at the expense of a fair trial which enables the offender to defend himself and gives him the chance to appeal. A trial and execution which are only separated by the interval of few hours does not fit the requirements of a fair trial.

  3. We demand that the PA acts to prevent such crimes through seriously and efficiently enhancing the rule of law which upholds equal protection for all citizens.
