Subject : Objection to Decision Concerning Ending of Residency of Musa Budeiri, your letter of 3.8.1999.


Your Objection concerning ending of residency of your clinet has been discussed, and I have decided in agreement with Mr Natan Sharansky, Minister of the Interior, the following :

1. Your statement that the residency of your client has been ended was not without foundation as has been claimed by you and defintly was not :

a - Your client married in England and all his family lives there since many years.

b - Your client has received a permit for permenant residence in the UK since his marriage in 1976 as was stated by you in his name in your letter of 1981.

c - Your client has acquired British citizenship through naturalisation and he posseses a UK passport since 1983.

As a result of the above and according to article 11a of the Law of Entry to Israel 1974, your client must be seen as someone who has resided outside Israel, according to the facts stated above.

2A. I am surpised that you refer to article 11 B of the Law of entry which does not apply in the case of your client.

B. Also article number 12 of the Law of Entry which you mention is not related to the subject, as the case here is not giving a status to someone who is born here, but the issue is the termination of a residency which has been granted.

3. Even so, when the details of the case of your client were examined, and it became clear than in his UK passport stamps have been placed, which are a returning resident to Israel stamps, by our ministry , numerous times, and as these stamps are given only to those who are permenant residents in Israel, it has been decided for the present time (in the meantime) that our office will not see your client as someone whose residence in Israel has ended.

And because the last returning resident entry issued to your client was in the year 1997, his case will be reviewed anew after the passage of six years from the day it was issued, i.e. in the year 2003.
